What is Copyright?

Copyright (denoted by the symbol ©) defines the legal ownership by the creator of an original “work of authorship" which can take any of the following forms: literary, dramatic, musical, artistic, and certain other intellectual works. This effectively equates to written text, program source code, graphics images, sculpture, music, sound recording, motion picture, pantomime, choreograph and architecture. The legal ownership also grants exclusive rights to the creator to produce copies and to control an original work. Copyright applies to both unpublished and published (i.e. in print) works. Copyright is almost universally respected internationally - the underpinning fundamentals being described under the Berne Convention and advised by the world intellectual property organisation (WIPO) – an internet search on these will give you more in depth information.

The most important point to remember is that copyright is an 'automatic right'– it comes into being once an artistic output emanates from your creative thinking and is captured in a ‘tangible’, fixed format (i.e. text, audio/video recording, physical artwork etc. Modern media formats have also meant that the tangible format has more often changed from e.g. paper and analogue tape to digital formats such as removable and fixed disc.

Incorporate your identity within your declaration of copyright by signing and dating your work along with the © symbol. That’s it – copyright is now legally yours. 

Well that's the theory. In practise, proving and securing your copyright in this way is far from watertight .....

 

 

How effective is copyright?

Imagine if you’ve written a new song or have taken an arty picture shoot and the next week your song is played on the radio or find one of your images in a magazine – someone has evidently infringed (i.e. copied) your work. This happens.

From an artist’s perspective, this can be extremely damaging both artistically and commercially. What’s more, the real difficulty is now trying to prove that you are the true and rightful creator/owner of this work. The biggest problem is that most artists fail to even take even the basic preliminary steps in copyrighting their work – it most often ‘still being worked on’ or on rough bits of paper and in files scattered all over the place. Even if you have remembered to write © / your name / date on your work, these days this isn’t really hard and fast proof in that anyone can realistically write any name and any date they wish. Therefore, when it comes to the crunch, in a court of law it can be your word against that of the infringing party.

 

 

How can I secure copyright in my work with more certainty?

The more supporting proof that you can personally evidence the better – i.e. maybe you’ve had radio play of your material or have a copy of a programme of an art exhibition that references display of your work- it’s this extra circumstantial evidence that can really help substantiate your copyright claim.

The best way is to formally register your work with a professional agent: a historical practice has been to lodge or register a copy of your works with a professional ‘safe keeper’ such as a bank. There are also certain document archive and so called 'copyright offices' that will perform a similar service of filing a copy of your material. As copyright, by definition, comes into being automatically, it is important to emphasise that you are not required to register your material at all but in doing so, you now have more solid formal proof that can be legally evidenced if required. Additionally, there are in fact no ‘official’ copyright services – even though this claim is sometimes alluded to. Registering your copyright by the ways suggested above, although effective, can be archaic, laborious, and expensive. Although you get a certificate of your registration, your material remains locked away in a dead end, black box filing system – to the point that you may not exactly remember what the material was you filed in the first place! What’s more you may be charged to obtain a copy of your work and some file services will periodically re-charge you a subscription cost you to keep your files on record.

So, whilst registration isn’t a requirement, if you’re serious about protecting your work – it does provide more formal evidence and proof. Additionally it makes things easier to be able to straightforwardly reference your copyright in the case of licensing and publishing of your works and can often form a necessary clause in a commercial contract or agreement.

All of this seems a bit long winded - Surely there has to be a better solution….

Why can't I just use a poor man’s copyright - a sealed envelope?

Copyright – Surely I can just send my material registered post to myself and not open the seal?  Well yes, but

A: You have to go to the trouble of doing this.

B: You can steam open any envelope so that’s where this old copyright fallacy falls down.

What types of file can I register?

Virtually all. Future Copyright’s inbuilt mediabox will only instant play mainstream files. Other file extensions, e.g. drawings etc you may have to open/download to use in the relative specialist software. Why is uploading of my files so slow?

If you’re used to transferring large file sizes you’ll realise that this is normal. For large file sizes and dependent on the actual speed of your internet connection file upload may take some time. Typically upload speeds wil range from 30 seconds per MB (high speed internet connection) to 5 minutes per MB (low speed internet connection).  We're currently working on a desktop upload utility so that you can schedule files to upload in the background - watch this space!

 

How can I allow another registered user/joint copyright owner to access my copyright portfolio?

You may wish to share access to certain Master Copy / Definitive version works to co-authors, agents, publishers etc. Use the permissions tab in your Copyright Portfolio index.The other user/s will need to be registered. You will then be able to set up a user group of selected users and set the permissions of your file from personal to restricted. Only members of the user group will be able to access the restricted files.  Your original Master Copy /Definitive versions of your copyrighted works of course remain as hard and fast prima facie evidence against any attempted copyright infringement.

 

How can I transfer copyright to someone else?

If you wish to wholly transfer your copyright (commercial, next of Kin), the easiest way is for the receiving party to register with Future Copyright. Contact us using the transfer of copyright link below including details of the file(s) you wish to transfer. Our support team will then perform the transfer of the requested file and copyright certificate and record the associated details.

What’s the best way to go about licensing or publishing/selling my work?

You can use Future Copyright as a powerful copyright management platform to licence or publish/sell your work. There are several excellent 3rd party publishing companies such as Create Space, Lulu, Fotolia, Shutterstock etc. Simply download and re-submit your master copy file to any of these sites, safe in the knowledge that you have secure copyright evidence. Licensing can be a complex arena. In the case of genuine 3rd party publishing or established commercial creative industry companies - these should have their own licensing agreements which you can use.
